National Interest Waivers
A National Interest Waiver (NIW) allows certain individuals to obtain permanent residence without a job offer or labor certification by demonstrating that their work benefits the United States national interest.
Eligibility Criteria (Matter of Dhanasar):
- Substantial Merit: The proposed endeavor has substantial merit and national importance
- Well Positioned: The individual is well positioned to advance the proposed endeavor
- Beneficial to Waive: It would be beneficial to the United States to waive the job offer and labor certification requirements

- Scientific research and innovation
- Healthcare and medical research
- Engineering and technology
- Education and academia
- Entrepreneurship in critical sectors
