National Interest Waivers

A National Interest Waiver (NIW) allows certain individuals to obtain permanent residence without a job offer or labor certification by demonstrating that their work benefits the United States national interest.

Eligibility Criteria (Matter of Dhanasar):

  1. Substantial Merit: The proposed endeavor has substantial merit and national importance
  2. Well Positioned: The individual is well positioned to advance the proposed endeavor
  3. Beneficial to Waive: It would be beneficial to the United States to waive the job offer and labor certification requirements

Common Qualifying Fields:

  • Scientific research and innovation
  • Healthcare and medical research
  • Engineering and technology
  • Education and academia
  • Entrepreneurship in critical sectors
