USCIS's new I-129 form asks much deeper questions and will force tough decisions on employers placing foreign workers at third-party worksites.

Department of Labor said that Peri Software, a 300 employee US company based in Newark, NJ, agreed to pay $638,000 in back wages and $127,000 in civil penalties for H-1B and labor condition application violations.

Abercrombie agreed to pay $1,047,110 for I-9 paperwork and systems violations and the historic fine was not the result of ICE finding even one unauthorized worker.

Starting 08/14/2010, employers with 50 or more US employees must pay an additional filing fee of $2,000 for new H-1B petitions and $2,250 for new L-1 petitions if 50% or more of their workforce is H-1B or L-1 workers.

As of Oct. 1, 40,600 of 65,000 regular H-1B cap numbers had been used and 14,900 of 20,000 master's cap numbers. E-3 for Chile and Australia are not part of the same cap.

USCIS announced on September 23, 2010 that it will raise filing fees beginning on November 23, 2010.  Filing fees will increase on average by 10%, but some fees will rise significantly more.

USCIS will speed F-1 change of status cases for students who otherwise could not continue work after September 30.  USCIS advised that it has the means to independently locate cap gap cases.

The Department of State announced in September that the China PRC reciprocity schedule for H-1 visas for Chinese nationals will be limited to 12 months.  USCIS I-797 approvals will not be affected.

Labor certification processing times fell to about four months. This is a substantial improvement over the year delay experienced as recently as several months ago.
